How can I get my horses back?
Last year, I bought two paints from a party. We came to an agreement as to price, and stable fees. The horses are paid off, completely. In December, I had a serious heart attack and was unable to get out to the stables. In February, we finally went out and my gelding was skin and bones. A mustang had been placed in the same paddock with my horses and they were barely allowed to eat. In February, my stable fees were raised and the stable owner promised to move the mustang. It was never done. Since July, I have been in and out of the hospital. Granted, I am two months behind in my fees. I was notified on August 16th that I had thirty days to remove the horses. When I called to tell him we’d be out to pick them up, he informed me he now wants $700.00 and is keeping the horses. Is this legal???
Did you sign an agreement stating that the horses can be taken in leu of payment if you don’t pay? If not, there is no reason why they should be using the horses to pay off your debt.
If you don’t have proof that they weren’t feeding your horses the amount you were paying for, you can’t not pay them, as different horses require different amounts of feed, and it isn’t the stables responsibility to keep your horse healthy for you. They are there to feed and maybe rug- whatever it is that is outlined in the agistment aggreement between you.
They can take you to court to get their money, but they don’t own your horses, you do. They can not take them from you. But you do owe them for the board, unless you can prove they did not perform the things you were paying them for.
I would call the police to get them to come with you to pick up the horses if I felt that the other party were going to make things difficult for you.
If they sell the horses, or do not agree to let you leave with them, I would definately take them to small claims court or call the police for stealing.
